These Terms and Conditions outline the rules and regulations for using our website and services. By accessing this website and subscribing to our services, you agree to comply with these terms.
2. Definitions
"Company", "We", "Us" refers to SpeedyLink Communications Limited.
"Customer", "You" refers to any individual or entity subscribing to or using our services.
"Service" refers to the internet and telecommunications services provided by SpeedyLink Communications Limited.
"SLA" refers to the Service Level Agreement, which governs service performance and compensation policies.
3. Scope of Services
SpeedyLink Communications provides internet services, including but not limited to:
Dedicated Unlimited Services
Unlimited Service Plans
Data-Capped Plans
Hotspot Internet
4. Service Availability and Performance
We guarantee a minimum service availability of 97.5% per calendar month.
Downtime that exceeds this threshold may qualify for service compensation in accordance with our SLA.
Service interruptions caused by scheduled maintenance, force majeure, or customer negligence are not covered under our uptime guarantee, hence will not be compensated for.
5. Billing and Payments
All invoices will be transparent and itemized.
Payments must be made within the designated 30-day billing cycle. Non-payment may lead to service suspension.
We offer multiple payment options for customer convenience.
Any billing disputes must be raised within 15 days of invoice receipt.
Payments:
The client agrees to pay the provider the following charges:
Installation Fee with one free month of 1-2 Mbps bandwidth internet subscription, payable upon execution of this Agreement.
Additional charges: the client shall be responsible for any additional charges incurred due to exceeding the agreed bandwidth and scope of the contract or any other services not covered under the standard package purchased. These charges will be billed separately.
6. Refund and Cancellation Policy
Customers may request a refund within 30 days of payment for valid reasons.
Refunds are subject to administrative processing, and delays may occur due to financial reconciliation.
If an installation service is canceled, refunds (if applicable) will be processed as per our refund policy.
7. Equipment and Maintenance
Customers leasing equipment must ensure its protection and return it in good condition upon termination of service.
Any damage or loss of leased equipment will be charged to the customer.
We will notify all customers at least 48 hours in advance for scheduled maintenance.
Emergency maintenance will be carried out with as much prior notice as possible.
7.1 Use of Equipment:
Permitted Use: The Customer agrees to use the equipment only for the intended purpose of accessing and enhancing SpeedyLink Communications' internet services.
Prohibited Use: The Customer shall not use the equipment for any unlawful or unauthorized activities, including but not limited to: tampering with the equipment, attempting to alter or modify it, or using it in any manner that violates local laws or the terms of service of SpeedyLink Communications.
Ownership of Equipment on Outright Payment: The radio equipment remains the property of the client on outright payment and is not subject to the retrieved clause of redundancy to the Provider network.
8. Lease Renewal and Purchase Options
The renewal of the lease agreement shall be on a yearly basis at a rate of N60,000 or a biennial basis at a rate of N110,000.
The client has the option to purchase the radio outright for N180,000 following the completion of the initial lease term and payment.
The renewal shall take effect upon the expiration of the original lease agreement, subject to the client’s execution of the renewal agreement and the payment of the agreed amount for the new term.
9. Responsibilities of the Provider
The Provider shall:
Provide the Client with the agreed-upon internet services as described in the SLA. Perform the regular maintenance and upgrades to ensure the services are functioning properly.
Respond promptly to service-related issues and provide technical support as outlined in the SLA.
10. Responsibilities of the Client
The Client shall:
Allow the Provider’s technicians to access the Client premises for installation and maintenance purposes during agreed-upon times.
Provide a suitable environment for the installation and operation of the equipment, including power supply and physical security.
Comply with all applicable laws, regulations, and guidelines related to the use of the services.
Notify the Provider promptly of any service-related issues or outages.
11. Termination
Either party may terminate this Agreement upon written notice to the other party in the event of a material breach of any provision of this Agreement. Termination shall be effective 30 days from the receipt of the written notice from either party.
12. Limitation of Liability
Exclusion of Provider’s Liability: SpeedyLink Communications is not liable for any damage to the equipment, loss of data, or personal injury that may occur due to improper use, neglect, or failure to follow the provided instructions for the equipment.
Limitation on Damages: In no event shall SpeedyLink Communications be liable for any indirect, consequential, or punitive damages arising from the use of the equipment. Also SpeedyLink Communications will not be liable for damages caused by act of God or force majeure.
Complaints can be submitted via our customer service channels.
We will acknowledge complaints within 24 hours and resolve them based on priority.
If unresolved, complaints can be escalated to our Quality Assurance team and ultimately to the Nigerian Communications Commission (NCC) if necessary.
Any dispute between the Parties shall be settled amicably by mediation or referred to and settled by arbitration in compliance with Nigerian laws. The decision of the arbitrator shall be binding on the Parties.
14. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria without regard to its conflict of laws principles.
15. Severability
If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
16. Agreement Acceptance
By signing this agreement or making a payment, both parties agree to the terms and conditions outlined above and acknowledge that they have the necessary authority to enter into this agreement.
